Questions of admissibility of transcript have arisen in the practice in numerous circumstances including where transcripts have been obtained during compulsory examinations under the Bankruptcy Act and/or Corporations Act and then subsequent attempts are made to use those transcripts in court proceedings.

Re Theodore Morris; exparte Max Christopher Donnelly as Trustee of the Bankrupt Estate of TC Morris v Colonial Mutual Life Society Ltd & Ors [1997] FCA 904.  This matter involved an application resulting in a ruling on the admissibility of transcript under s 81 of the Bankruptcy Act 1966 (Cwth).
